Acceptable Use Policy

The open internet only works when infrastructure is not used to deceive, exploit, attack, or overwhelm others. These rules apply to every HYPERHOSTGATE Service.

1. Scope and customer responsibility

You are responsible for activity through your account, including activity by users, applications, credentials, and systems you control.

This Acceptable Use Policy (“AUP”) forms part of the Terms of Service. It applies to use of HYPERHOSTGATE hosting, network, compute, storage, DNS, support, and related services, including Customer Content and traffic.

You must take reasonable steps to secure your systems, keep contact information current, investigate complaints, and ensure that your end users and contractors follow this AUP. You may not help another person perform conduct that this AUP prohibits.

2. Illegal, deceptive, or harmful content

Do not use the Service for unlawful activity, rights violations, exploitation, threats, or deception.

You may not use the Services to create, host, distribute, or facilitate:

  • content or conduct that violates applicable law or a binding court order;
  • child sexual abuse material, sexual exploitation, or grooming;
  • credible threats, targeted harassment, stalking, or incitement of violence;
  • fraud, impersonation, phishing, credential theft, or deceptive schemes;
  • material that infringes copyright, trademark, privacy, publicity, or other rights;
  • unlawful sale or distribution of controlled goods, weapons, or stolen data; or
  • activity designed to conceal or support any prohibited use.

We do not decide private disputes merely because one party objects to another’s lawful content. Reports should identify the specific material, location, legal basis, and supporting evidence.

3. Security abuse, malware, and unauthorized access

Testing systems you own is allowed; attacking or probing systems without authorization is not.

You may not use the Services to:

  • deploy or control malware, ransomware, botnets, cryptojacking, or malicious code;
  • gain or attempt unauthorized access to accounts, devices, data, or networks;
  • scan, exploit, or test a third-party system without documented authorization;
  • launch, amplify, coordinate, or sell denial-of-service attacks;
  • intercept traffic or credentials without lawful authority;
  • evade authentication, rate limits, abuse controls, or security monitoring; or
  • publish credentials, exploit code, or personal data primarily to enable imminent harm.

Authorized security research

Good-faith testing of systems you own or are expressly authorized to test is permitted when it does not disrupt others. Testing HYPERHOSTGATE systems requires advance written authorization; see Trust & Security.

4. Spam and abusive messaging

Commercial messages need a lawful basis, honest routing information, and a working opt-out.

You may not:

  • send bulk or commercial messages without the consent or other legal basis required in each destination;
  • use purchased, scraped, harvested, or deceptively obtained recipient lists;
  • forge headers, sender identity, domains, or routing information;
  • continue messaging a recipient after a valid opt-out;
  • operate an open relay or insecure form that predictably enables spam; or
  • use another provider to send prohibited messages while using our Service as the landing page, redirect, or control point.

You must maintain suppression records and comply with applicable anti-spam, privacy, and electronic-marketing laws.

5. Network integrity and fair use

“Unmetered” describes the billing model, not infinite capacity. Shared resources must remain usable and secure for others.

You may not intentionally degrade the Services, monopolize shared resources, circumvent technical limits, or generate traffic primarily to manipulate usage metrics or impose cost. Prohibited examples include packet amplification, abusive crawling, address misrepresentation, route hijacking, and persistent workloads that materially impair other customers.

We may apply documented technical limits, rate controls, or a reasonable-use threshold necessary to protect shared infrastructure. Where practical, we will contact you before taking action and offer a suitable plan or configuration. A specific committed capacity must be written in the Order.

6. Restricted and high-risk workloads

Some lawful workloads need prior review because they create unusual safety, regulatory, or capacity risk.

Contact us before using a Service for public cryptocurrency mining, high-volume proxy or VPN resale, weapons control, biometric identification, regulated health or financial data, critical infrastructure control, emergency communications, or another use where failure could reasonably cause death, serious injury, or substantial physical damage.

Approval may require a specialized Order, security review, geographic restriction, additional safeguards, or may be declined. The Services are not designed as a substitute for certified life-safety or emergency systems.

You must comply with applicable export-control and sanctions laws and may not use the Services where provision is legally prohibited.

7. Investigation and enforcement

We aim for proportionate action: investigate, preserve evidence, limit harm, and give notice when doing so is safe and lawful.

We may investigate credible reports and request information needed to evaluate them. Depending on severity, urgency, history, and legal duties, we may warn you, require remediation, rate-limit traffic, quarantine content, suspend an affected resource, or terminate a Service.

We may act without advance notice when reasonably necessary to stop imminent harm, respond to a valid legal order, protect the Services, or prevent evidence destruction. When practical, we will scope action to the affected resource, explain the basis, and provide a route to respond. We may preserve relevant records as required by law or for security and dispute handling.

8. Reporting a violation

Specific reports are faster to investigate. Include URLs, timestamps, evidence, and a safe way to contact you.

Use our Report Abuse page for security abuse, spam, phishing, malware, unlawful content, and intellectual property reports. Do not send passwords, private keys, full payment card numbers, or unnecessary sensitive personal data.

Knowingly submitting a materially false report, impersonating an affected person, or using the process to harass another party violates this AUP.

9. Questions and updates

Ask before launching an unusual workload. We will post material AUP changes with an updated date.

We may update this AUP as threats, technology, and law change. Material changes apply prospectively, with notice for current paid customers when reasonably possible.
